hi people, i am currently working on a project and i was wondering if i decide to use images i found on the internet, would i have to request permission from the owner of the images to sell the games..Let me know please because i heard if u change 70% of the image then you can say its yours...
And if i do decide not to sell it, will i be able to use the images???
Hayo's right - few people will buy a game with ripped graphics. Do you mean you're going to use none-game images like images of the sky, trees, vehicles, etc.?
yeah, im using wallpapers such as football wallpapers like arsenal, man utd, etc... not using ripped graphics for games, thats dumb, basically im looking to use around 100-150 wallpapers, backgrounds etc...for my project
If they're football related, you're probably not going to be allowed to use them legally. American Football is strict about using NFL-branded broadcasts, photos, and other things, and even beyond that, photographers themselves have a lot of control over their work. I'm sure football/soccer is the same.
I'd wager a guess even the team names are closely guarded.
then what if i decide to release it for free, and of course statin that this gameis in no way affiliated with blah blah blah, etc.. if its for free ishould be able to use them right

Technically you can't even do that. Football clubs have complete legal control over their copyrighted logos, photos and all other things. I used to run a website about my local team, and found out that I couldn't even list fixture dates, nor take pictures inside stadia for my own use - the Premier League and the Football League own everything.
However, my own experience is that if you weren't selling the game for money, they wouldn't do anything about it (unless it somehow shone bad light on a certain club). But yeh, don't sell it, or they'll bum you.
Yeah, it's a complicated issue. That's why a lot of people change it into a parody or something. Like from Manchester United to Rochester United or something, with different colors, etc
Changing 70% of the image is not really correct. The copyright is on the image itself. The trademarks are on shapes and colors. Like if you took a Coca Cola image and changed the words, you're still violating the trademarks. Coca Cola owns the colors and the shape of the bottle, so you'd need to use different colors (like green and black) and make a different shaped bottle. You can get away with changing just 20% of the image as long as you change whatever is trademarked.
A rule of thumb is that for it not to be illegal, it should be different enough for nobody to recognize it. It's still illegal even if it is free.
But enforcement is a different thing. Nobody really wants to sue a kid with no money for stealing their intellectual property.
Disclaimer: Any sarcasm in my posts will not be mentioned as that would ruin the purpose. It is assumed that the reader is intelligent enough to tell the difference between what is sarcasm and what is not.
you know what ill jus spill the beans.
Im workin on a football quiz game that going to have like 3000's questions, so i was gonna get alot of wallpapers(football ones) to use as backgrounds etc...Yeah ims ure if you dont sell it and it dont offend any other team in any way then it should be ok.
The average player couldn't care less if the graphics are ripped. How would he know? Why would he care (about any part of development process of the game he's just playing for fun)? If the graphics look good and they fit to the (enjoyable) gameplay (yes, it is possible with ripped graphics), then you will sell the game if the price is right and you have sufficient amount of visibility for your game. Of course legal constraints must be considered if you don't want to get sued.
It's true that other developers won't buy your game with ripped graphics (because they view and rate it differently than the average player) but it rarely makes sense to target other developers with a commercial game.
Naturally the best way is to go with your own custom graphics. But to say that selling a game with ripped graphics would be impossible is very short-sighted.
ok then how about this, im sure even this is not allowed, i am going to get people to design like 100 wallpapers for example, and all of the ones i use, mos prob like 100 i will use themand everyones image which i use wil get credited on the game, but even that iwil not be allowed right. im sure i can,
I think i will most likely release the first one for free then see how it is, but if i get a very good response then we will see, then again if i get a good response i might even decide to release the sequel for free 2 lol...
You see the interface and everything i can design all of that because i am very good, i haveyears if experience, but ill see what the response it anyways.. thnx for the comments guyz..

I sharply disagree. I used to make games with ripped graphics, they blended together very well, and every single person I knew, pointed it out to me. I've even had a lot of people accuse me of not making the game because they recognized the graphics. So no, the average player does care, they do know, and it will look bad on you.
very true, well i guess that answers my questions, well i will use certain wallpaper but the game look and everything will be original, thank you for all of your comments and will definately speak soon
